Here are a few general principles to keep in mind as you read through this Policy:
We may update this Policy from time to time in accordance with Section 11 (Changes to this Policy) and invite you to review this page periodically. All changes will go into effect on the “Last Updated” date indicated on the Policy.
Individuals Under the Age of 18: We do not knowingly collect the Personal Information of individuals under 18 years of age. If we discover that a person under the age of 18 has provided us with Personal Information, for example by registering for a Godiva account using the Services, we will delete such information. If you are under 18 and want to make a purchase or otherwise use Godiva services that require the collection, use, or disclosure of Personal Information, please ask a parent or guardian to place the order for you.
Collection of Personal Information That You Provide Us:
Additionally, we may aggregate Personal Information in a manner such that the end-product does not personally identify you or any other user of the Services. For example, we may use Personal Information to calculate the percentage of our users who have a particular telephone area code.
By using our Services, you consent to our use of these tracking technologies as described above.
Collection of Personal Information Through Social Media: We maintain a presence on several social media and blogging platforms, such as Instagram, Facebook, Pinterest and Twitter. Through these platforms and features, we collect your Personal Information and usage information about you on the Services. Third party social media platforms have their own privacy policies which explain how the third parties that provide them will collect, use, and disclose your Personal Information. In accordance with those policies (and your privacy settings within your social media accounts), information about your activities on our Services may be published to your social media profile.
We also include tools on our Services that allow you to share and/or publicly post content or information from our Services to your profile on third party social media platforms. Third party social media platforms have their own privacy policies which explain how the platform providers will collect, use, protect and share your information, including any information you share on those platforms from our Services, and we encourage you to read them. We do not assume responsibility for the privacy practices of third-party social media platform providers, and we encourage you to review all third-party privacy policies prior to using third party social media platforms.
How We Use Personal Information: We may use your Personal Information to perform the following business functions:
We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or allowed by law.
We work with third parties who provide services to us and we may share Personal Information with such third parties for the purpose of enabling these third parties to provide services to us. Such service providers may include client support specialists, webhosting companies, client data management and enhancement companies, payment processors, fulfillment companies (e.g., companies that fill product orders or coordinate mailings), data analysis firms and email service providers. Such third parties may be provided with access to Personal Information needed to perform their functions on our behalf, but may not use such information for any other purpose and we require that the service providers maintain the confidentiality of your Personal Information and keep your Personal Information secure. Our employees and service providers may be located in foreign jurisdictions, and your Personal Information may be subject to the laws of those foreign jurisdictions and/or accessible to law enforcement and other authorities. For written information about our policies and practices regarding overseas service providers, contact us by using the contact information set out in Section 14 (Contacting Godiva).
The Site and Godiva communications sometimes include notices of sweepstakes or other promotions we are conducting, and we may permit you to enter electronically in some cases. If that occurs, we will use the information you provide for the purpose of conducting the promotion (e.g., to contact you if you are a winner in connection with a promotion). In addition, we may participate in internet related promotions sponsored by third parties. In these instances, if you are a participant in such promotions, we may provide certain Personal Information to these third parties in furtherance of the promotion on our behalf. These parties have agreed to hold this information in confidence, not use it for any purpose except to carry out the requested service, and honor our privacy and security policies in the way this information is handled.
From time to time, we may also conduct questionnaires and surveys and we may contact you via email, postal mail or phone. Survey Personal Information is treated like all of the Personal Information we collect, and it is used to help us improve the appeal of our products and our Services.
Members can access, review and/or correct their Personal Information that was provided to us online by visiting the following URL: https://www.godiva.ca/sign-in. To obtain access or to correct other Personal Information, or if you wish to have your Member account deleted, you may send an email requesting such access, or the deletion to firstname.lastname@example.org.
The Site offers Users live customer service assistance. Users of this service may disclose Personal Information. This Personal Information is used to help facilitate the customer service representative in assisting with the inquiries they receive from the User.
Godiva does not represent or warrant that the Services, or any part thereof, is appropriate or available for use in any particular jurisdiction other than Canada.
We have physical, organizational, contractual and technological security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the Personal Information under our control. Godiva also uses Secure Sockets Layer (SSL) technology. SSL encrypts the data submitted to our Services so that only we can decode your information, so long as SSL is supported by your web browser and enabled when your information is submitted. Unfortunately, no method of data transmission or data storage system can be guaranteed to be 100% secure, and we cannot guarantee absolute security. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please notify us of the problem as soon as possible by contacting us in accordance with Section 13 ("Contacting Godiva") below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem). To safeguard your privacy, we need your help. When registering an account on the Services, please be sure to choose an account password that is difficult for others to guess, and that you do not use on any other website or account, and never reveal it to anyone else. If you use a shared or public computer, DO NOT choose to have your login ID or password remembered and be sure to log out of your account completely every time you leave the computer. Also, please verify that your web browser has a secure connection to the Services before entering any Personal Information and avoid including Personal Information in e-mails to us (particularly credit card or banking information).

We may change this Policy from time to time. When we do, we will let you know by posting the changed Policy on this page with a new “Effective Date.” In some cases (for example, if we significantly expand our use or sharing of your Personal Information), we may also tell you about changes by additional means, such as by sending an e-mail to the e-mail address we have on file for you. In some cases, we may request your consent to the changes.
